Western Digital warrants to the original end user that the hardware in the Platform Product (“Product”), when properly installed, used, and maintained, will be free from defects in materials and workmanship and will substantially conform to Western Digital’s specifications for such Product during the Warranty Period, as described below. This Limited Warranty for HGST and Western Digital Brand Platform Products (the “Limited Warranty”) applies to new HGST and Western Digital Brand Products purchased through Western Digital’s authorized sales channel by the original end user for normal use and not for resale. The warranty is not transferrable from the original end user.
The Limited Warranty does not cover non conformance resulting from (i) misuse, accident, negligence, modification or alteration to the hardware; (ii) use of the Product outside Western Digital’s specified operating environment;(iii)failure to perform required maintenance or the improper performance of maintenance; or (iv) failures caused by a product for which Western Digital is not responsible. There is no warranty of uninterrupted or error‐free operation or defects in design. There is no warranty for loss or damage of data. Data Recovery is not covered under this warranty and is not part of the warranty returns process. The Limited Warranty does not cover support of the Product. Support for the Product may be purchased separately, under Western Digital’s support agreement terms and conditions and support offerings definitions.
The Warranty Period for Western Digital’s offerings varies by product. The Warranty Period for specific HGST or Western Digital products, including the Product, can be found at www.westerndigital.com. The WarrantyPeriodforany spare parts purchased for the Products begins from the date of shipment from Western Digital, regardless of when the spare parts are actually installed for use.
Before seeking limited warranty service, users should first follow the troubleshooting procedures that Western Digital or your reseller/distributor provides.
Unless unavailable, Western Digital will provide replacements at the Field Replacement Unit (FRU) level. Western Digital will ship the FRUs transportation prepaid. FRUs may be previously used, repaired and tested to meet Western Digital’s specifications. Title to the FRU transfers upon delivery to the carrier at the Western Digital shipping point. Western Digital retains title to the returned Product. You are responsible for importation of the FRU, if applicable. Western Digital will not return the defective part, therefore, the end user is responsible for moving data to another media and/or deleting sensitive data before returning. Western Digital FRU is warranted for the remainder of the original Product warranty or 90 days, whichever is greater.
If Western Digital cannot provide replacements at the FRU level, it may instead provide a product with at least equivalent capabilities to the failed Product. The equivalent product is warranted for the remainder of the original Product warranty or 90 days, whichever is greater. If Western Digital cannot provide a replacement at the FRU level or an equivalent product, it may instead provide the user with a credit based on the Product’s original purchase price and remaining warranty term. If Western Digital elects an equivalent product replacement or credit, user must return, and Western Digital must receive, the complete failed Product before such product or credit will be provided.
To obtain limited warranty service, you must first obtain a Return Materials Authorization, the applicable FRU, and ship‐to address by contacting the appropriate Call Center listed at http://www.westerndigital.com/support. Returns must be in Western Digital approved packaging. All returns for the Product must be sent to the Western Digital designated return location. You are responsible for all transportation charges, duties and insurance in shipping the returned hardware to WesternDigital.Youshould remove all personal information from the Product prior to its return.
OTHER THAN AS EXPRESSLY STATED HEREIN, WESTERN DIGITAL DOES NOT PROVIDE ANY OTHER WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF IMPLIED WARRANTIES, SO THIS LIMITATION MAY NOT APPLY TO YOU. This Limited Warranty shall be governed by the laws of the State of California. Any claim or dispute shall be resolved exclusively by the state or federal courts in the County of Santa Clara, California. No limited warranty is provided by WD unless your WD Product ("Product") was purchased from an authorized distributor or authorized reseller. Distributors may sell Products to resellers who then sell Products to end users. Please see below for warranty information or obtaining service. No warranty service is provided unless the Product is returned to an authorized return center in the region (warranty regions are identified as Canada, U.S.A., Latin America, Europe, Middle East, Africa, Asia Pacific, India and Thailand) where the Product was first shipped by WD, which may have regional specific warranty implications.
If your Product was purchased as a component integrated within a system by a system manufacturer, no limited warranty is provided by WD. Please contact the place of purchase or the system manufacturer directly for warranty service.
Nothing in this warranty modifies or excludes your legal rights under the Australian Competition and Consumer Act or the New Zealand Consumer Guarantees Act. This warranty identifies WD's preferred approach to resolving warranty claims which is likely to be quick and simple for all parties.
No other warranties either express or implied by law, including but not limited to those contained in the Sale of Goods Act, are made with respect to the Product. If you purchased your Product in New Zealand for the purposes of a business, you acknowledge and agree that the New Zealand Consumer Guarantees Act does not apply.
In Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure. What constitutes a major failure is set out in the Australian Consumer Law.
Warranty
WD warrants that the Product, in the course of its normal use, will for the term defined below, be free from defects in material and workmanship and will conform to WD’s specifications. Proof of purchase shall be required to be eligible for this warranty and to establish the commencement date of this warranty. Warranty service will not be provided unless the Product is returned to an authorized distributor, authorized reseller or regional WD return center where the Product was first shipped by WD. WD may at its discretion make extended warranties available for purchase. WD shall have no liability for any Product returned if WD determines that the Product was (i) not purchased from an authorized distributor or authorized reseller, (ii) not used in accordance with WD specifications and instructions, (iii) not used for its intended function, or (iv) stolen from WD, or that the asserted defect a) is not present, b) cannot reasonably be rectified because of damage occurring before WD receives the Product, or c) is attributable to misuse, improper installation, alteration (including removing or obliterating labels and opening or removing external enclosures, including the mounting frame, unless the product is on the list of limited user-serviceable products and the specific alteration is within the scope of the applicable instructions, as found at https://support-en.wd.com), accident or mishandling while in the possession of someone other than WD.
PRODUCTS ARE COMPLEX AND FRAGILE ITEMS THAT MAY OCCASSIONALY FAIL DUE TO (A) EXTERNAL CAUSES, INCLUDING WITHOUT LIMITATION, MISHANDLING, EXPOSURE TO HEAT, COLD, AND HUMIDITY, AND POWER FAILURES, OR (B) INTERNAL FAULTS . SUCH FAILURES CAN RESULT IN THE LOSS, CORRUPTION, DELETION OR ALTERATION OF DATA. NOTE THAT YOU SHALL BE RESPONSIBLE FOR THE LOSS, CORRUPTION, DELETION OR ALTERATION OF DATA HOWSOEVER CAUSED, AND FOR BACKING UP AND PROTECTING DATA AGAINST LOSS, CORRUPTION, DELETION OR ALTERATION. YOU AGREE TO CONTINUALLY BACK UP ALL DATA ON THE PRODUCT, AND TO COMPLETE A BACKUP PRIOR TO SEEKING ANY GENERAL SERVICE AND TECHNICAL SUPPORT FROM WD.
In Australia, if the Product is not of a kind ordinarily acquired for personal, domestic or household use or consumption, provided it is fair and reasonable to do so, WD limits its liability to replacement of the Product or supply of equivalent or better Product.
This warranty shall extend to repaired or replaced Products for the balance of the applicable period of the original warranty or ninety (90) days from the date of shipment of a repaired or replaced Product, whichever is longer. This warranty is WD’s sole manufacturer's warranty and is applicable only to Products sold as new.

If you wish to make a claim, you should initially contact the dealer from whom you originally purchased the Product. If it is determined that the Product may be defective, you will be given an RMA number and instructions for Product return. An unauthorized return (i.e., one for which an RMA number has not been issued) will be returned to you at your expense. Authorized returns must be shipped in an approved shipping container, prepaid and insured, to the address provided with your RMA number. If following receipt of a qualifying claim under this warranty, WD or the dealer from whom you originally purchased the Product determines that your claim is valid, WD or such dealer shall, at its discretion, either repair or replace the Product with an equivalent or better Product or refund the cost of the Product to you. You are responsible for any expenses associated with a claim under this warranty. The benefits provided to you under this warranty are in addition to other rights and remedies available to you under the Australian Competition and Consumer Act or the New Zealand Consumer Guarantees Act.

No Product may be returned directly to WD without first contacting WD for a Return Material Authorization ("RMA") number. If it is determined that the Product may be defective, you will be given an RMA number and instructions for Product return. An unauthorized return, i.e. one for which an RMA number has not been issued, will be returned to you at your expense. Authorized returns are to be shipped prepaid and insured to the address on the RMA in an approved shipping container Your original box and packaging materials should be kept for storing or shipping your Product. If upon inspection of your returned Product WD suspects fraud or deems such Product to be counterfeit, WD may, in its sole discretion, confiscate such Product or take such other actions as it deems necessary. Limitation of Remedies
YOUR EXCLUSIVE REMEDY FOR ANY DEFECTIVE PRODUCT IS LIMITED TO THE REPAIR OR REPLACEMENT OF THE DEFECTIVE PRODUCT.
WD may elect which remedy or combination of remedies to provide in its sole discretion. WD shall have a reasonable time after determining that a defective Product exists to repair or replace a defective Product. WD's replacement Product under its limited warranty will be manufactured from new and serviceable used parts. WD's warranty applies to repaired or replaced Products for the balance of the applicable period of the original warranty or ninety days from the date of shipment of a repaired or replaced Product, whichever is longer.
Limitation of Damages
WD'S ENTIRE LIABILITY FOR ANY DEFECTIVE PRODUCT SHALL IN NO EVENT EXCEED THE PURCHASE PRICE FOR THE DEFECTIVE PRODUCT. THIS LIMITATION APPLIES EVEN IF WD CANNOT OR DOES NOT REPAIR OR REPLACE ANY DEFECTIVE PRODUCT AND YOUR EXCLUSIVE REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
No Consequential or Other Damages
NOTWITHSTANDING ANYTHING ELSE IN THIS POLICY OR OTHERWISE, WD WILL NOT BE LIABLE WITH RESPECT TO THE PRODUCTS UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY (I) FOR ANY AMOUNT IN EXCESS OF THE PURCHASE PRICE FOR THE DEFECTIVE PRODUCT OR (II) FOR ANY GENERAL, CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR SPECIAL DAMAGES. THESE INCLUDE LOSS OF RECORDED DATA, INTERRUPTION OF USE, THE COST OF RECOVERY OF LOST DATA, LOST PROFITS AND THE COST OF THE INSTALLATION OR REMOVAL OF ANY PRODUCTS, THE INSTALLATION OF REPLACEMENT PRODUCTS, AND ANY INSPECTION, TESTING, OR REDESIGN CAUSED BY ANY DEFECT OR BY THE REPAIR OR REPLACEMENT OF PRODUCTS ARISING FROM A DEFECT IN ANY PRODUCT. THIS SECTION DOES NOT LIMIT LIABILITY FOR BODILY INJURY OF A PERSON.

If an alphabetic character appears after the Product date code (example: 05 Apr 99 X), the Product has been re-certified and may not be subject to the terms of WD's warranty as it applies only to products sold as new.
Retail Kits that are assembled and branded by Western Digital, along with internal drives sold as "Component Drives" (internal hard drives that WD sold and specifically did not package as part of a Western Digital assembled and branded retail kit), come with a limited warranty. Depending on the type of sales transaction, product warranty may differ from the general warranty information listed herein.

Recertified Products
WD recertified products may consist of customer return units and may be repaired. All products are tested and determined to meet WD's stringent quality standards before they are sold as recertified. Please note that some recertified items may have marks, scratches, or other slight signs of wear.

Western Digital warrants that the SSD Product (“Product”), when properly used and installed in conformance with Western Digital’s specifications for such Product, will be free from defects in materials and workmanship and will substantially conform to Western Digital specifications for such Product during the Warranty Period.
This Limited Warranty applies to new Western Digital Ultrastar and HGST SSDs (“Product”) purchased from an authorized dealer by the original purchaser for normal use and not for resale.
Western Digital Product warranties for SSD Products last for different periods of time and are limited by the useful life of the flash media used for the Product. To determine the warranty time period for your specific Product, please visit www.westerndigital.com. The warranty for the product will expire on the earlier of (i) the date when the flash media has reached one-percent (1%) of its remaining life or (ii) the expiration of the time period associated with the Product. You may determine the remaining useful life of the flash media by using the “SMART” feature (E9) (“Lifetime Remaining Percentage”) of the Drive Manager software. Drive Manager software is available as a free download from Western Digital. A valid proof of purchase may be required to prove eligibility. If you do not have a valid proof of
purchase, the limited warranty period will be measured from the date of sale from Western Digital to the authorized distributor
If you are having trouble with a Product, before seeking limited warranty service, first follow the troubleshooting procedures that Western Digital or your reseller/distributor provides. To obtain limited warranty service, you must first obtain a Return Materials Authorization and ship-to address by contacting the appropriate Western Digital Call Center listed at https://www.westerndigital.com/support. You must return the covered Product using approved packaging to our logistics center. Packaging guidelines can be found at: https://www.westerndigital.com/support/packaging-instructions. You must pay any associated transportation charges, duties and insurance in shipping the drive to our logistics center. You should remove all personal information from the Product prior to its return.
Western Digital will replace the Product with a functionally equivalent replacement Product, transportation prepaid. Western Digital may replace your Product with a product that was previously
used, repaired and tested to meet Western Digital specifications. You receive title to the replaced Product at delivery to the carrier at the Western Digital shipping point and Western Digital retains title
to the returned Product. You are responsible for importation of the replaced Product, if applicable. Western Digital will not return the original drive to end users; therefore, the end user is responsible for
moving data to another media before returning. Data Recovery is not covered under this warranty and is not part of the warranty returns process. Western Digital warrants that the replaced Products are
covered for the remainder of the original Product warranty or 90 days, whichever is greater.
The limited warranty does not cover damage resulting from misuse, accident, negligence, modification or alteration to hardware or software, tampering, unsuitable physical or operating environment
beyond Product specifications, improper maintenance, or failure caused by a product for which Western Digital is not responsible. There is no warranty of uninterrupted or error-free operation or
defects in design. There is no warranty for loss or damage of data—you must regularly back up the data stored on your Product to a separate storage product. There is no warranty for Product with removed or altered identification labels. There is no warranty for any software related to or associated with the Product, including without limitation, software drivers, tools, or applications and all software is provided AS IS. WESTERN DIGITAL DOES NOT PROVIDE ANY OTHER WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
