Testimonial Release Agreement

By responding to the questions and requests set forth in this submission form, e-mail or otherwise communicated to me by Grantee related to any comments I submit related to Grantee’s products, I, the respondent, on behalf of myself and, if applicable, my employer/company (collectively, the “Grantor”) hereby grant to Western Digital Technologies, Inc., including its affiliated companies, and suppliers (collectively, “Grantee”) the unqualified, perpetual, irrevocable, transferable, sublicensable, worldwide right and license to use, including without limitation reproduce, print, display, publish, broadcast, and make derivative works of, my name, or submitted username, and responses (collectively, “Responses”), in Grantee’s sole discretion and in any form, in all types and kinds of Grantee publications, marketing materials, advertisements, websites, intranet sites, video and multimedia presentations and the like throughout the world (collectively, “Materials”) for any purpose whatsoever, including, but not limited to, advertising, display, public relations, social media, marketing or designs.

Grantor hereby waives any right to inspect or approve the Materials incorporating or referencing the Responses. Grantor further waives any claims that it may have to the eventual use to which the Responses may be applied. Grantor irrevocably waives all rights and releases Grantee and its parent and subsidiary companies, directors, officers, employees, affiliates, and agents from, and shall neither sue nor bring any proceeding against any such party for, any claim or cause of action, whether now known or unknown, arising out of or in connection with the use, misuse, and/or exploitation of the Responses, including but not limited to, any claims for defamation or invasion of right to privacy, publicity, or personality.

Grantor understands that it will not receive, and it has no right to, any compensation in connection with the Responses. Grantor hereby represents that: (i) Grantor is at least eighteen (18) years old; (ii) to the best of Grantor’s knowledge, Grantor’s statements in the Responses are true and correct; and (iii) Grantor has all necessary rights and permissions to provide the Responses for use in the Materials as permitted above.
